Terms & Conditions

The terms that govern every purchase.

LAST UPDATED: 14 AUGUST 2026 · APPLIES TO THEBRANDVOICEPRINT.COM AND COPYLEXA SERVICES

1. About us

We are Alexandra Cho, trading as The Brand Voiceprint (ABN 12 720 565 716), and these are the terms on which we supply our Services to you (Terms). You can contact us at alex@thebrandvoiceprint.com.

2. Services

We offer two tiers of service:

Both tiers result in delivery of a machine-readable brand voice specification and accompanying prompt instructions, together with the accompanying materials described on our website for your tier. The Live Session additionally includes a human-readable brand guide and installation support. Full details of each tier, including what is included and current pricing, are set out on our website. The tier that applies to you is either set out in the sign-off page attached to these terms or confirmed at the time of your online purchase.

3. Variations

Changes to the Services need to be written and agreed upon by both parties. They will be priced as per the rate advertised on our website or as mutually agreed. If your requests change the scope of services or our duties, we are not required to follow them unless agreed in writing as stated.

4. Price and payment terms

You agree to pay the Price before we commence the Services. If you are signing up online, payment is processed at the time of purchase via Stripe or a similar online payment platform. If you are entering into these Terms by hard copy, payment is due by invoice.

5. Currency

All prices displayed on our website and charged for the Services are in United States Dollars (USD). Where you pay via Stripe or a similar online payment platform and your card or account is denominated in a different currency, your card issuer or bank will apply its own currency conversion rate and any associated fees or charges. We are not responsible for, and do not receive, any amount charged to you for currency conversion or foreign transaction fees. All prices are exclusive of GST unless otherwise stated. Where GST applies to a supply made under these Terms, including supplies to customers in Australia, GST will be added at checkout or itemised on the relevant invoice at the prevailing rate.

6. Late payments

If you don't pay on time as agreed, we can choose to stop providing the Services 5 business days after the payment was due and we can also ask you to pay for any extra costs we face because you didn't pay on time. This includes any costs to get those payments from you.

7. Included revisions

Each tier includes the following revisions to your brand voice specification:

No refunds are offered under either tier. We do not guarantee that any AI platform (including ChatGPT and Claude) will continue to produce consistent results using the deliverables over time, as this depends on changes made by third party AI providers outside our control.

8. Rescheduling and no-shows (Live Session)

You may reschedule your Live Session once at no charge, provided you give us at least 72 hours' notice. Rescheduling requests with less notice, or a failure to attend at the agreed time without notice, will be treated as a forfeited session, and we are not obliged to offer a further session or a refund. Any additional rescheduling beyond the one free reschedule is at our discretion and may be subject to a fee as advised by us at the time.

9. Audits and additional services

Beyond the audit and retuning rounds included with the Live Session under clause 7, we may from time to time offer a separate audit service, under which we review your brand voice specification, assess whether it continues to perform effectively as third-party AI platforms evolve, and retune it where necessary. Separate audits do not form part of the Included Revisions above, are only available where we have made them available on our website or agreed them with you in writing, and are subject to separate pricing and payment terms as advised by us at the time. We may also offer additional services from time to time, including installation or implementation of your deliverables within third-party platforms, which are offered separately and are scoped, priced and agreed in writing before any work begins.

10. Client obligations

You agree to provide us and our team with all necessary documents, information and cooperation required for us to deliver the Services, including completing any quiz or questionnaire, providing writing samples and brand materials, and, where your tier includes one, attending a live workshop session at the agreed time. A discovery call is optional and is not a condition of purchase; where you choose to book one, we ask that you attend at the agreed time or reschedule with reasonable notice. You are responsible for correctly implementing the deliverables in accordance with any instructions we provide. We are not liable for any results, outputs or losses arising from your modification of the deliverables (other than your completion or updating of materials that are designed to be completed or updated by you, in accordance with their instructions) or from your failure to implement them as instructed.

11. Recording and transcription

Where we conduct a discovery call or a live workshop session with you, we may record and transcribe that session for the purpose of delivering the Services. By booking or attending the session, you consent to this recording and transcription. We will otherwise handle any such recording in accordance with our Privacy Policy.

12. Intellectual property

13. Termination for breach

These Terms can be terminated by either party (the Non-Defaulting Party) with immediate effect if the other party (the Defaulting Party) fails to fulfil a significant obligation under these Terms. If the Defaulting Party does not correct the breach within 10 business days after receiving written notice from the Non-Defaulting Party, the Non-Defaulting Party has the right to terminate these Terms immediately.

14. Liability

We will perform our services with reasonable care and skill. However, we are not liable for any indirect or consequential losses that may arise, including any loss arising from changes made by third party AI providers to their platforms which may affect the performance of the deliverables. Subject to your consumer law rights, our total liability under these Terms is limited to the Price paid by you.

15. Confidentiality

Both parties commit to maintaining the confidentiality of any proprietary or confidential information shared during the course of our engagement.

16. Subcontracting

We reserve the right to subcontract any portion of the Services at our discretion without needing to get your written approval beforehand. We commit to being fully responsible for fulfilling our obligations under these Terms, and we will ensure that any subcontractors we employ adhere to these Terms as if we were performing the Services directly.

17. Relationship of parties

These Terms are not intended to create a partnership, joint venture, employment or agency relationship between the parties.

18. Governing law

These Terms are governed by the laws of Western Australia.

19. Dispute resolution

In the event of a dispute, the parties will first attempt to resolve the matter through mutual discussion or mediation.

20. Amendments

We may update these terms and conditions from time to time by posting a revised version on our website. The version of the terms in force at the time you purchase will apply to your order. Any changes to the specific Services or Price agreed with you require written agreement from both parties.
